"Psychological violence" refers to acts or omissions causing or likely to cause mental or emotional suffering of the victim such as but not limited to intimidation, harassment, stalking, damage to property, public ridicule or humiliation, repeated verbal abuse and mental infidelity. It includes causing or allowing the victim to witness the physical, sexual or psychological abuse of a member of the family to which the victim belongs, or to witness pornography in any form or to witness abusive injury to pets or to unlawful or unwanted deprivation of the right to custody and/or visitation of common children.” Under the Family Code of the Philippines: “Art. 26. All marriages solemnized outside the Philippines, in accordance with the laws in force in the country where they were solemnized, and valid there as such, shall also be valid in this country, except those prohibited under Articles 35 (1), (4), (5) and (6), 3637 and 38. (17a) Where a marriage between a Filipino citizen and a foreigner is validly celebrated and a divorce is thereafter validly obtained abroad by the alien spouse capacitating him or her to remarry, the Filipino spouse shall have capacity to remarry under Philippine law. (As amended by Executive Order 227)”

    @Your_Lawyer Thanks for this nuggets attorney. I have a question po Atty. I’m a Former Filipino Citizen. Now I’m Canadian Citizen. No plan for dual citizenship for now. I’m planning to get marry in the Philippines, one of the requirements for Marriage License is Certificate of Legal Capacity to Contract Marriage since I’m considered foreigner. My question is am I still qualified to get a CENOMAR in the PsA and use that instead of the Certificate of Leagal Capacity to get Married? Thank you po. Looking forward po for your advice.

    The reason for all this is money. Dito kaya sa Pinas may package deal yang annulment kays mahal. From 250,000 pesos and above. Ginagawa kasing negosyo ng mga abogado at judge yan.
  • If both became Canadian citizens, can the last will of either of the ex couple whoever die first, not to give any inheritance of a property in the Philippines (which was purchased when they were already separated) to the one who is still alive, be challenged by the ex wife/husband even though they have separated for many years aside from being both non Filipino citizens?     Hi Atty., sana po mabigyan nyo po ako ng sagot, Norwegian citizen ako nung nghiwalay kami ng Norwegian husband ko at nbuntis ako 4 months before na-approved yung divorced nmin. (Nbuntis ako sa ka-live in ko now). Kapag uuwi kami ng Pinas mkasuhan ba ako ng adultery? Married pa pala record namin sa Pinas. Nasa Dumaguete nkatira yung ex-husband ko.
  • Attorney how if the wife got married to another man with annulment papers without the signature of the legal husband or any approval from the husband whether in verbal or in paper)would their be a case that can be filed for this against the wife by the husband?
