He certainly knew how to hold a real gun from the way he held that cell phone. If some one held a cell phone pointed at you in the dark what would you think?

One of the councilmen shouldve answered “Yeah that definitely looks like a gun. Any other questions?”

Unfortunately homeboy here is not too smart. Yes it looks like a gun. If your running from the cops, whether you're Hispanic, Black, Asian or Caucasian, and your not compliant to redirection holding a object in your hand your going to get lite UP! Poor law enforcement, damn if you do, damn if you don't

(b) An agent may use deadly force to stop a fleeing suspect when the agent has probable cause to believe that the suspect has committed, or intends to commit, a felony involving the infliction or threatened infliction of serious bodily injury or death, and the agent reasonably believes that there is an imminent or future potential risk of serious bodily injury or death to any other person if the suspect is not immediately apprehended. Under such circumstances, a verbal warning should precede the use of deadly force, where feasible.

at first glance hell YES! upon closer view then no.  But why in any instance would you hold a cell phone like a gun?
