Subdivision continues to ban pickup parking despite new Florida HOA law

We’ve told you about the new state law that prevents homeowners’ associations from banning pickup trucks and work trucks from parking in driveways. It took effect July 1, and already, one Sarasota HOA is saying it will continue to hand out fines and tow vehicles under its existing regulations.

  • HOA's don't enact laws for safety or security, they do it for control. Some people get a "high" controlling others.

  • No way in hell i would ever live somewhere where they could tell me what i could and could not park in my own driveway. I'll never understand why anyone with a brain would.

    I just resigned from being president of my HOA. Trying to change dumb, restrictive rules like this one was such a waste of time. Any time a change was mentioned at a meeting people would throw a literal tantrum with no awareness of reality or truth, pounding the tables and screaming over nonsense ams gibberish... The whole HOA thing is a bad idea because the majority of people are staggeringly idiotic.

    My HOA sucks too. At the meetings they always say they have over $400,000 in reserves, yet they want to hike the HOA fees so they'll have money "just in case". They pay a security company $28,000 a year to have a guy who barely speaks English walk around 3 days a week from 1pm-9pm, and hand out violation notices for cars being parked incorrectly or not having their parking pass hanging from the rear view mirror. He gave me one for that because my mirror fell off the windshield and I placed the tag on the dash so he can easily read it when he made his rounds. But because it wasn't hanging on the mirror, I got a warning. He's not here to police the property for the residents, he's here to police the residents for the property. Any crime that happens will happen after 9pm so it's pointless to even pay $28,000 a year for 24 hours a week of "security".

    My dad has a close friend in Fort Myers who’s HOA pulled this stunt. The guy has a $100k loaded out Denali 2500 truck and got letter from his HOA. He Started parking the truck at my dad’s property and then bought the ugliest beater of a car he could find. Now he drives the beater to my dad’s when he wants to use the truck. I’m sure the HOA loves looking at his beat up 97 caprice classic.

    He could sue for declaratory judgment to declare HOA rules illegal.

    We had a similar problem a few years back, some ole boy went to the HOA meeting and shot the shit out of a bunch of them. Things became much clearer after that.

    Sue the HOA … if there is a law saying the HOA can not stop you from having a truck in their driveway then sue the HOA and/or recall the board

    So the HOA is breaking the law? Seems simple. HOA policies don't supersede the law.
