This critical incident community briefing is intended to provide you with information regarding a K-9 contact – Use of Force, resulting from an incident that occurred in the City of Toledo on April 11, 2024.

We are currently in the initial stages of a comprehensive investigation into the use of force incident.
It's important to note that our understanding of the incident may evolve as we gather and review additional evidence. We refrain from making conclusions about the officers' adherence to policies and laws until all facts are thoroughly examined, and the investigation is finalized.

On April 11, 2024, Toledo Police officers received an alert from FLOCK cameras of a stolen vehicle in the
area of North Detroit Ave. and W. Central Ave. FLOCK cameras are stationary license plate readers that will alert area law enforcement of reported stolen vehicles and plates, wanted persons, and aid in criminal investigations. The altered plate was pictured by FLOCK on a red Dodge Ram truck, which was
registered to a Chevy Malibu.

A Toledo Police K-9 unit located the truck at N. Detroit Ave. and Delaware Ave. The K-9 officer conducted a traffic stop on the truck at Albion and Hood and was eventually backed up by other officers. During the stop, Mr. Upchurch was not fully compliant with the orders being given to him by officers. Mr. Upchurch was eventually taken into custody after a K-9 apprehension.

Upon further investigation, it was discovered that the FLOCK camera had misread the plate and neither the plate nor the vehicle were stolen.

This investigation will be reviewed by The Internal Affairs Bureau for adherence to department policy and procedures
